In response to the Obama Administration’s callous and illegal flouting of American law, as filed by the Obama Administration’s Environmental Protection Agency and the U. S. Department of Justice yesterday in Murray Energy Corporation’s lawsuit challenging the Obama EPA’s refusal to comply with Section 321(a) of the Clean Air Act of 1971, Mr. Robert E. Murray, Murray Energy’s Chairman, President, and Chief Executive Officer, issued the following statement:

“The response to the Federal Court filed yesterday by Barack Obama, Gina McCarthy, and the U. S. Department of Justice is deeply offensive to the Court, to the employees of Murray Energy and their families, and to those Americans who rely on the lowest-cost and most reliable electricity, which coal provides. Indeed, the Obama EPA has plainly admitted in their filing that they have never counted the job losses required under Section 321(a) of the Clean Air Act of 1971 and will require up to two (2) years to do so. They have totally flouted and ignored the law and the Court,” said Mr. Murray.

“In their prosecution of this case, the Department of Justice has become just as complicit as Barack Obama and Gina McCarthy in their clear disregard for the law and family destruction that their policies have caused. Indeed, their filing makes it abundantly clear that they have absolutely no intention of following the Court Order and, instead, will try to continue to delay legal compliance for at least two (2) more years, all the while continuing to inflict pain and financial ruin on our Nation’s coal miners and their families and in destroying the most reliable and lowest-cost electricity in America. This hurts all Americans, particularly those citizens who are poor, or on fixed incomes, and manufacturers whose products must compete in the global marketplace,” Mr. Murray added.

“As such, there needs to be a stay of all anti-coal regulations involving the Clean Air Act that have been issued under the Obama Presidency,” continued Mr. Murray.

“Our Nation’s coal miners, and their families, cannot endure the continued destruction of their lives by the illegal regulations and actions of the Obama Administration. Murray Energy Corporation will continue to fight back in order to save these American jobs and family livelihoods, and the most reliable, lowest-cost electricity in America,” stated Mr. Murray.
